These terms and conditions ("terms and conditions of sale") are valid in the event of the purchase of the mariglianohome.com products offered on the website. The products contained on the website are produced and sold by Marigliano Home.

The seller may update these terms and conditions of sale and use and the privacy policy at any time and without notice. When sending an order through the website, the user is required to accept the terms and conditions of sale and use and the privacy policies in force on the date of sending the order.

1. PURCHASE ORDER

1.1 The products sold on the website www.mariglianohome.com can be purchased and delivered exclusively in the countries indicated in the order form.
 1.2.2 To date, all models are available in the flexible antishock pro version. 1.2.3 In the case of purchasing models in pairs, the available material will prevail and they will both be worked in the same way. 1.2.4 ATTENTION: the covers are printed on rubber, no additional materials are applied, the glitter/leopard/gold/etc versions are only effective color combinations. 1.3 While we take all necessary efforts to reproduce as exactly as possible the colours, design and style of the products presented on the website, it is possible that differences may be found due to the characteristics of the computer used by the user. Therefore, the seller cannot be held responsible for any errors or inaccuracies relating to photographs and graphic representations of the products displayed on the website. 1.3.1 We specify that we will not be responsible for any text errors, we therefore invite you to check before placing the order, the first letter will always be capitalized unless there are any communications before the order. 1.4 Offers on products and prices are valid subject to availability. When completing the order, all instructions on product availability are provided; in the event of unavailability of a product following the order, notification will be sent promptly and it will therefore be possible to order another product on the website or cancel the order. In case of cancellation, a refund will be made immediately.
 1.5 Before sending an order, the customer receives an order summary message containing details on the selected items, quantities and prices. You must read this summary carefully before confirming your order.
 1.6 The seller cannot be held responsible in the event of unavailability of the warehouse or lack of products.
 1.7 The seller reserves the right to modify the products offered on this website at any time and without notice.

2. ORDER CONFIRMATION - BINDING AGREEMENT

2.1 All orders are subject to written acceptance by the seller and will therefore be confirmed by the seller via e-mail.

2.2 Before completing the order, you will be asked to confirm that you have read the general conditions of sale including the information on the right of withdrawal and the processing of personal data.

2.3 The confirmation of the order by the seller and these terms and conditions of sale will be considered as a final and perfected agreement between the seller and the user relating to the points contained in these terms and conditions of sale.

2.4 The order cannot be subject to corrections or cancellations except in the cases provided for herein or in accordance with applicable legislation.

2.5 The data recorded by the website constitutes proof of the entire transaction that took place between seller and customer. In the event of a dispute between the seller and one of the customers regarding a transaction carried out on the website, the data recorded by the website will be considered irrevocable proof of the transaction and its contents.

4. SHIPPING AND DELIVERY

5.1 The shipment takes place via express courier GLS, SDA Poste Italiane, LICCARDI Express, the preparation of the package takes place within 24/48 hours after which the order status will be set to "Shipped" at which point the package will be entrusted to the courier GLS, SDA in Italy the average times provided by our couriers are 24/48 hours throughout the national territory, excluding islands and disadvantaged areas. 5.2 An email will automatically be generated containing the tracking to follow the delivery status. 5.3 Upon receipt of the product it will be necessary for someone to be present at home to sign for the delivery. 5.5 Insured shipping covers any accidental damage to the products or in the event of their loss. If shipping without insurance is selected, FLR assumes no responsibility for the receipt of damaged products or in the event of loss. 5.6 Shipping is offered for the city of Naples (Arenella, Avvocata, Chiaia, Fuorigrotta, Mercato, Montecalvario, Pendino, Poggioreale, Porto, Posillipo, San Carlo all'Arena, San Ferdinando, San Giuseppe, San Lorenzo, Soccavo, Stella, Vicaria, Vomero) for orders placed from Monday to Friday from 9.30 to 16.30 on soft cover models.

5. RIGHT OF WITHDRAWAL (RETURN) OR EXCHANGE

5.1 This right (pursuant to and for the purposes of Legislative Decree 6 September 2005, n. 206 "Consumer Code"), which can only be exercised by Private customers, consists in the right to return the purchased goods to the supplier without any penalties and the consequent reimbursement of the purchase price. 5.2 The consumer can exercise this right within fifteen (15) working days of receiving the products, by notifying our offices within seven (7) days of receipt. 5.3 this right is subject to the following conditions:
- The products must not have been used or damaged and must be returned intact at the Customer's expense;

- No returns will be accepted and it will not be possible to proceed with a refund or exchange of the items if the returned products are opened, worn or if they are not contained in the original packaging;
-Items being returned/exchanged must be sent in the original packaging using thick, durable cardboard packaging (not an envelope). Any non-compliance will result in a 10% restocking fee. 5.4 Upon receiving the return, the seller will check the returned items to ensure their integrity and may, at its discretion, only determine whether the products being returned are in original condition. 5.5 The seller cannot be held responsible in the event of loss, incorrect address or late delivery of the items being returned. 5.6 ATTENTION Given that this right cannot be exercised in the case of the purchase of personalized products, we waive the possibility of making an exchange by paying only the €9 return shipping fee. The conditions for sending the product back to us remain unchanged. 5.7 The costs of returning the product will be borne by the consumer who can use the shipping method he deems most appropriate.

Refunds will be made using the same payment method used for the purchase specifically:
- If you paid by card the refund will be made to the same card as the payment;
- If you purchased on delivery (it will not be possible to make a financial refund) but a discount voucher of the same value as the order will be given.

6. RETURN/EXCHANGE PROCEDURE:

-The refund or exchange of the product may be subject to confirmation of the defect by customer service. 

-After authorization for the return/exchange by customer service, prepare the packaging and send the product within 7 days of receipt to the address indicated by the assistance service. Wait for the new shipment or refund. Refunds will be made using the same payment method used for the purchase. For cash on delivery payments, a discount code of the same value as the order will be assigned.

  • All return shipments sent without authorization will be returned to the sender with a cost charged to the sender.

The right of withdrawal is however subject to the following conditions :

• The Customer is required to return the goods after authorization from the assistance service within 7 working days and communicate the tracking of the shipment ;
• The direct costs of returning the goods will be borne by the Customer, who will also be responsible for the decrease in the value of the goods resulting from handling of the goods other than that necessary to establish the nature, characteristics and functioning of the goods;
• The right applies to the product purchased in its entirety;
• It is not possible to exercise withdrawal only on part of the purchased product (e.g.: accessories, attached software, etc...);
• The purchased good must be intact and returned in the original packaging , complete in all its parts (including any documentation and accessory equipment: manuals, cables, etc...);
The shipment, until the certificate of receipt in our warehouse, is under the complete responsibility of the Customer ;
• In the event of damage to the goods during transport, fleuurs.com will notify the Customer of the incident, to allow him to promptly file a complaint against the courier he has chosen and obtain reimbursement of the value of the goods (if insured). In this case, the product will be returned, with shipping costs borne by the Customer, simultaneously canceling the withdrawal request;
• Fleuurs.com is not responsible in any way for damage or theft/loss of goods returned by uninsured shipments;
• Upon arrival at the warehouse, the product will be examined to assess any damage or tampering not resulting from transport.

The right of withdrawal is totally lost, due to the lack of the essential condition of integrity of the goods (packaging and/or its contents), in cases where Fleuurs.com ascertains :

• The lack of the original external/internal packaging;
• The absence of integral elements of the product (accessories, cables, manuals, parts, ...);
• Damage to the product for reasons other than its transport or for exceeding the time limits established by law for causes not deriving from fleuurs.com.
• In the event of forfeiture of the right of withdrawal, Fleuurs.com will return the purchased goods to the sender, charging the shipping costs to the sender.

Any total or partial reproduction by any means (except as expressly provided herein) as well as any distribution, publication, transmission, modification or sale of information and materials contained in the website is expressly prohibited.

7.2 You may not remove or alter any copyright, trademark or other proprietary notices contained on the Website or its contents. You may access or view the content of the Website on your computer or other devices and you may make a single copy of the web pages published on the Website for your private, personal and non-commercial use, provided that on each copy of such web pages all copyright notices and other copyright notices contained on the site. 

8. PRODUCTION

We work hard to guarantee your satisfaction and make sure that our products are always in perfect condition, our products are designed, printed and packaged in Italy by highly qualified staff.

9. LIMITATION OF LIABILITY

 Seller shall not be liable to any user or other third party for any direct, incidental, special or consequential damages, including, without limitation, product losses or other intangible losses arising out of or in connection with the use of or inability to use the website, even where the company has provided information on the possibility of such damage.

10. WARRANTY EXEMPTION

 10.1 The seller does not warrant or represent that the website is free of viruses or other harmful material, or that the information contained on the website is accurate, complete or up-to-date.

10.2 We make no warranty that the website or the services, content, functions or materials provided through the website will be timely, secure, consistent or error-free, or that such defects can be corrected.

10.3 The website and contents are provided as they are and are available. The seller cannot make any warranties of any kind, express or implied, relating to the website. 

11. APPLICABLE LAW, COMPETENT COURT

These agreements are governed by Italian law, regardless of any conflicts or selection of legal provisions. You acknowledge and agree that Italy is the chosen location for any disputes and that the courts located in Italy will have jurisdiction over this agreement and over you.
